1. Acceptance of Terms
By accessing or using BookIt Technologies' services ("Services"), including our website, SMS booking assistant, and web booking pages, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
2. Description of Services
BookIt provides an AI-powered appointment booking platform that enables businesses to accept bookings via SMS text messaging and web-based booking pages. Our Services include AI-assisted scheduling, appointment reminders, and business management tools.
Waitlist: When all appointment slots are full, customers may be added to a waitlist. They will be notified via SMS when a slot becomes available. Waitlist notifications expire after 2 hours if not accepted.
3. Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to create a business account
- You are responsible for all activity that occurs under your account
- You must promptly notify us of any unauthorized access to your account
4. SMS Messaging Terms
By interacting with BookIt via SMS:
- You consent to receive appointment and payment-related text messages from the business you are booking with, powered by BookIt Technologies
- Message frequency varies based on your booking activity
- Message and data rates may apply depending on your mobile carrier
- You can opt out at any time by replying STOP to any message
- Reply HELP for assistance or contact support@bookittechnologies.com
- Consent to receive messages is not a condition of any purchase
- Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major US carriers
5. Business User Obligations
If you are a business using BookIt, you agree to:
- Provide accurate business information, hours, and service details
- Honor appointments booked through the platform
- Comply with all applicable laws regarding customer communications
- Not use the platform to send spam, unsolicited messages, or marketing content outside of appointment and payment-related communications
- Maintain appropriate professional licenses and insurance for your services
6. AI Assistant Disclaimer
Our AI booking assistant is designed to help schedule appointments accurately. However, the AI may occasionally make errors. BookIt is not liable for scheduling mistakes, miscommunications, or missed appointments resulting from AI interactions. Users should verify appointment details through confirmation messages.
7. Plans, Trial, and Billing
Free Plan
BookIt offers a Free plan at $0/month with no credit card required. The Free plan includes a hosted booking page on bookittechnologies.com, Google Calendar sync, customer database, email confirmations and reminders, and up to 3 services. The Free plan does NOT include a dedicated phone number, AI SMS receptionist, SMS reminders, voice answering, or BookIt Pay. The "Powered by BookIt" footer appears on Free plan booking pages.
Paid Trial
New users may be eligible for a 30-day free trial of a paid plan, subject to availability. The trial includes a dedicated phone number and up to 100 bookings. One trial per user. Trial phone numbers are released upon expiration unless you subscribe to a paid plan. Free plan users may upgrade to a paid trial at any time.
Subscription Billing
- Business accounts are billed on a monthly recurring subscription basis.
- Your subscription will automatically renew on the same day each month until you cancel. By subscribing, you expressly authorize BookIt Technologies to charge your payment method on a recurring monthly basis until you cancel.
- Prices may change with at least 30 days' advance notice by email.
- ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. ALL SALES ARE FINAL. We do not issue refunds for any reason, including partial months, unused services, early cancellation, or dissatisfaction with the service. If you cancel, you retain access through the end of your current billing period and will not be charged again, but no refund will be issued for that period or any prior period.
- Failure to pay may result in immediate suspension or termination of your account and phone number.
- You are responsible for maintaining current payment information on file.
BookIt Pay (Customer Payments)
Business owners can send payment requests to customers via SMS. Payments are processed through Stripe. BookIt charges a platform fee of $0.50 per transaction. BookIt does not store credit card information.
- Businesses may use BookIt Pay to collect payments from customers for services rendered
- Payment links are sent via SMS and processed securely through Stripe
- Payments are made directly to the business's connected Stripe account
- BookIt Technologies does not hold or process customer funds — Stripe handles all payment processing
- Stripe's standard processing fees apply to each transaction
- Refund and dispute policies are determined by the individual business and Stripe's terms
8. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Send spam, unsolicited messages, or harassing content
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Impersonate any person or entity
- Use the Services to transmit malicious code or viruses
- Send messages to recipients who have opted out (replied STOP)
- Auto-dial or conduct mass unsolicited messaging campaigns
- Resell, sublicense, or reverse-engineer the platform
- Violate U.S. export control laws
9. Intellectual Property
The BookIt platform, including its design, features, and content, is owned by BookIt Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our Services without our written consent.
10. Disclaimer of Warranty and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BOOKIT TECHNOLOGIES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. We do not guarantee any specific level of uptime, availability, response time, or message delivery. Marketing descriptions such as "always on" describe product design intent, not a contractual guarantee of uninterrupted service.
To the maximum extent permitted by law, BookIt Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Account Termination and Cancellation
- You may cancel your subscription at any time from your Billing page or by contacting support@bookittechnologies.com. Cancellation takes effect at the end of your current billing period. You will not be charged again, but no refund is issued for the remainder of the current period or any prior period.
- Upon cancellation, your phone number will be released and cannot be recovered. Your AI booking assistant will be deactivated.
- Your account data — including appointment records, customer contact information, and message history — will be retained for 30 days after the end of your final billing period, after which it will be permanently deleted. You may request a data export before that time by contacting support@bookittechnologies.com.
- We may suspend or terminate your account immediately and without prior notice for violation of these Terms, non-payment, suspected fraud, regulatory requirements, or any reason we determine in our sole discretion. In non-emergency cases, we will attempt to provide reasonable notice.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Continued use of the Services after changes constitutes acceptance of the revised Terms. For material changes affecting your subscription fees, billing terms, or legal rights, we will provide at least 30 days' advance notice by email to the address associated with your account. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
13. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws principles. Any disputes not subject to the arbitration clause below shall be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction in those courts.
13.5. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
You and BookIt Technologies agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (including billing disputes, refund claims, and account termination) shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.
YOU AND BOOKIT EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
Claims may only be brought in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. This arbitration agreement survives termination of your account and these Terms.
14. Indemnification
General Indemnification
You agree to indemnify, defend, and hold harmless BookIt Technologies and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or data you submit through the Services.
BookIt as Conduit
BookIt Technologies acts as a messaging conduit and is not the author, editor, or publisher of any messages sent through the platform. You are solely responsible for the content, legality, and accuracy of all messages sent from your account.
SMS Messaging & 10DLC Compliance
By using BookIt Technologies' SMS booking services, you ("the Business") acknowledge and agree:
- You are the registered brand and sender of all SMS messages sent through your BookIt phone number.
- You are solely responsible for ensuring your messaging complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA), FCC regulations, and carrier requirements.
- BookIt Technologies registers your 10DLC brand and campaign on your behalf as a Communications Service Provider (CSP). This registration does not constitute legal advice.
- You confirm that all business information provided during registration is accurate and complete.
- You agree to indemnify, defend, and hold harmless BookIt Technologies from any and all claims, damages, fines, penalties, and costs arising from your messaging activities, including but not limited to carrier fines, TCPA violations, and regulatory actions. This indemnification is not subject to any liability cap and survives termination of your account.
- Misrepresentation of your business information or messaging use case constitutes a material breach of these Terms.
- BookIt Technologies reserves the right to suspend or terminate your messaging services if your account violates carrier policies or regulatory requirements.
